1. Agreement
By downloading, accessing, or using Clocked, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Clocked. You must be legally able to enter this agreement. If you use Clocked for an organization, you represent that you can bind it to these Terms.
2. What Clocked provides
Clocked is a personal tracking tool that helps you record purchases and uses, calculate cost per use, set personal value targets, and view related estimates and summaries. Results depend on the information you enter. Clocked does not connect to your financial accounts and is not financial, investment, tax, accounting, legal, health, or purchasing advice.
We may improve, change, suspend, or discontinue features. We will try to provide reasonable notice if a material change affects paid functionality, but cannot promise uninterrupted or error-free availability.
3. Your account
You are responsible for maintaining access to the Apple account used to sign in and for activity under your Clocked account. Provide accurate information and promptly report suspected unauthorized access. You may not transfer, sell, or share account access in a way that compromises security.
You may delete your account in Settings. Account deletion is permanent once processed and removes access to synced content. Keep any export you want before deletion. Removing the app or disconnecting a sign-in provider does not by itself delete the Clocked account.
4. Clocked Unlimited and App Store purchases
Clocked Unlimited is offered as a one-time, non-consumable in-app purchase that unlocks the features described at the time of purchase. It is not an auto-renewing subscription. Apple processes the transaction, maintains purchase records, and controls refund eligibility under App Store terms. Prices and taxes may vary by storefront.
You may restore an eligible purchase using the same Apple ID. A purchase does not guarantee that every feature will remain unchanged forever, but we will not intentionally convert the purchased lifetime entitlement into a recurring subscription for the same promised access.
5. Your content and license
You retain ownership of item information, notes, photos, and other content you submit. You grant Clocked a limited, non-exclusive license to host, process, reproduce, and transmit that content only as needed to provide, secure, sync, and support the service. This license ends when the content is deleted, subject to ordinary backup retention and legal obligations.
You are responsible for your content and must have the right to upload it. Do not use Clocked to store illegal content, malware, highly sensitive credentials, payment card numbers, or content that violates another person’s rights.
6. Acceptable use
You may not misuse Clocked, attempt unauthorized access, probe or disrupt the service, bypass limits or purchase controls, automate abusive traffic, introduce malicious code, use the service to violate law, or reverse engineer the app except where applicable law expressly permits it. We may restrict access when reasonably necessary to protect users, the service, or legal rights.
7. Intellectual property
Clocked, its software, visual identity, text, and other product materials are owned by Nikhil Kapur or licensed to him and are protected by intellectual-property laws. These Terms grant only a limited, personal, revocable, non-transferable right to use the app as intended.
8. Disclaimers
To the maximum extent permitted by law, Clocked is provided “as is” and “as available” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that calculations, projections, synchronization, or data will always be complete or error-free. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
9. Limitation of liability
To the maximum extent permitted by law, Nikhil Kapur will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost opportunities, or lost data arising from Clocked. Total liability for claims relating to Clocked will not exceed the greater of the amount you paid for Clocked during the twelve months before the claim or US $25. These limits do not apply where liability cannot legally be limited.
10. Indemnity
To the extent permitted by law, you agree to defend and indemnify Nikhil Kapur from claims, losses, and reasonable costs arising from your unlawful misuse of Clocked, your content, or your violation of these Terms or another person’s rights.
11. Governing terms and disputes
These Terms are governed by the laws applicable where the developer resides, without regard to conflict-of-law rules, except that mandatory consumer protections in your home jurisdiction still apply. Before filing a claim, you agree to contact support and attempt an informal resolution for at least 30 days. Nothing in these Terms prevents either party from seeking urgent injunctive relief or using small-claims court where eligible.
12. Apple terms
Apple is not a party to these Terms and is not responsible for Clocked or its support. Apple may enforce these Terms as a third-party beneficiary where required by the App Store’s standard end-user license terms. Your use of Clocked must also comply with applicable App Store terms.
13. Changes and severability
We may update these Terms. Material updates will be communicated as appropriate, and continued use after the effective date constitutes acceptance where permitted by law. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue.
